INFORMATION ON THE PROCESSING OF PERSONAL DATA

 

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “Regulation”, please read the information below:

  1. WHO IS THE DATA CONTROLLER OF YOUR PERSONAL DATA?

The Data Controller is the entity that determines the purposes and means of the processing of personal data. Your personal data will be processed by Nuenn Jarosław Łukaszewicz, NIP 9562015572, REGON 363668969, with its seat in Wrocław, Plac Solny 15, 50-062 Wrocław, Poland (hereinafter referred to as “Nuenn” or “Data Controller“).

  1. WHAT PERSONAL DATA DO WE PROCESS, FOR WHAT PURPOSE AND ON WHAT BASIS?
  • your personal information may be processed for the purposes of current and/or future recruitment and/or team collaboration processes and/ or business opportunities – relating to software and/or IT services provided by Nuenn and/or its business partners or associates (if you agree to be processed for these purposes), as well as for purposes that are in the legitimate interests of Nuenn;
  • your data are processed pursuant to Article 6(1)(a), (b), (f) of the Regulation;
  • the processing of data for recruitment purposes is based on your free and explicit consent;
  • processing is necessary for the performance of the contract between you and Nuenn and/or to take action at your request before entering into the contract;
  • Nuenn has a legitimate interest in the provision of software-related and/or IT-related services.
  1. IS THE PROVISION OF DATA VOLUNTARY?

The provision of personal data by you is a condition of your participation in recruitment and/or cooperation. The consent is voluntary, but the consequence of not providing personal data will be that you will not be able to take part in the recruitment/ business selection process.

  1. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

Your personal data, processed for the purpose and to the extent necessary to carry out the recruitment and/or cooperation process, will be stored until the lapse of period of limitation for claims concerning participation in the recruitment and/or cooperation process.  Your personal data processed for the purpose of providing information about vacancies and/or opportunities for cooperation and ongoing recruitments will be stored until your consent is withdrawn.

  1. WHAT RIGHTS DO YOU HAVE WITH REGARD TO THE PERSONAL DATA YOU PROCESS?
  • the right of access to your personal data (Article 15);
  • the right to rectify and update your data (Article 16);
  • the right to restrictions on data processing (Article 18);
  • the right to object (Article 21);
  • the right to data portability (Article 20);
  • the right to erasure (Article 17);
  • the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before withdrawal.

The following rights do not apply:

  • The right not to be subject to a decision which is based solely on automated processing, including profiling (Article 22) – Nuenn will not take any decision concerning you which is based on automated processing.
  1. WHO DO WE SHARE YOUR PERSONAL INFORMATION WITH?

Your data will not be shared with anyone other than those authorized by law – except to engaging another processor on the basis and for the purpose of executing the contract between Nuenn and such processor.

  1. DO WE TRANSFER YOUR PERSONAL DATA TO COUNTRIES OUTSIDE THE EUROPEAN ECONOMIC AREA?

Your personal data may be transferred to a third country or international organisation (outside the EEA) if one of the following conditions is met:

  • the processing is carried out by a further processor in a third country for which an adequacy decision as referred to in Article 45 of the Regulation has been issued;
  • processing is carried out by a further processor who participates in the Privacy Shield Programme;
  • processing is carried out by a further processor under the binding corporate rules referred to in Article 4(A)(3). (3) the processing is carried out by a further processor under binding corporate rules referred to in Article 4(20) and Article 47 of the Regulation;
  • the processing is carried out by a further processor on the basis of standard contractual clauses between Nuenn and the further processor.

Data Protection Officer at Nuenn has not been appointed.
